1. General

1.1. Payment terms are 14 days from invoice; however, payment must be received before the course begins. For individual learners (self-funded bookings), full payment must be made at the time of booking and any course materials, learning resources, or login details (where applicable) will only be issued once payment has been received. For business, employer, or company-funded bookings, liability for all course fees commences upon booking. Course materials, learning resources, and login details (where applicable) may be issued upon invoice, subject to the agreed payment terms. Phoenix Health & Safety reserves the right to refuse admittance to the course until payment is received.

1.2. Phoenix Health & Safety reserves the right to cancel or alter the dates or provision of service, the venue and the individual or organisation providing the service. This includes moving classroom courses to our online blended service where we are unable to reasonably provide a classroom environment. In the event of a course cancellation, bookings will normally be deferred to the next available course at the same venue unless the client specifically requests otherwise. If a booking is cancelled or deferred by the client, Phoenix Health & Safety reserves the right to apply the below charges. These charges also apply to in-house training courses or consultancy services cancelled or deferred by the client.

1.3. In addition, Phoenix Health & Safety reserves the right to charge a £30 administration fee for each cancellation/deferral. Telephone cancellations/deferrals can be accepted but have to be received 7 days prior to course commencement and should be confirmed immediately in writing (by post, fax or email). For cancellations/deferrals within 7 days preceding the course commencement date, Phoenix Health & Safety reserve the right to pass on any such delegate fees that they incurred for each day of the course deferral.

1.4. Provisional bookings are not permitted. Bookings are confirmed once submitted and are subject to cancellation terms above.

1.5. Fees quoted are correct at time of publication, but Phoenix Health & Safety reserves the right to alter fees at any time.

1.6. These terms shall be governed by and construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the English court.

1.7. Payment Terms and System Access

1.8. In the event that any invoice remains unpaid for more than thirty (30) days from the invoice due date, the Supplier reserves the right to suspend or revoke the Customer's access to any online systems, platforms, software, portals, or other digital resources provided under this agreement. Access will be reinstated once all outstanding amounts have been paid in full.

2. Consultancy Services

2.1. Any risk assessments conducted (if applicable) are general risk assessments required by the Management of Health & Safety at Work Regulations 1999. This does not include more specific risk assessments as required by other regulations, unless specified.

2.2. Telephone/email support (if applicable) covers any work that does not involve the physical travel to the client’s site. If extra work on client’s site is required, this will be charged at an agreed amount.

2.3. In the case of the telephone/email support contracts, the contract start date will be the date the client signs to accept the proposal.

2.4. Annual telephone/email support contracts will automatically renew on their anniversary. If the client does not wish to renew the contract, they must notify Phoenix Health & Safety in writing at least 30 days prior to the end of the contract. 

3. Classroom Courses

3.1. Whilst we will try to maintain ideal numbers of delegates to tutors, this is not always possible. The final decision on number of delegates per course is made by Phoenix Health and Safety.

3.2. Phoenix Health & Safety reserves the right to deliver a course by using one or multiple trainers. Whilst the same trainer will always be used where possible, this is not always practical.

3.3. Course materials are kept under continuous review via rigorous quality procedures. Phoenix Health and Safety cannot be held responsible for any omissions or errors in the course materials.

3.4. Phoenix Health & Safety cannot be held responsible for unforeseen circumstances (including acts of God) that affect the running/delivery of a course. We will endeavour to work with our clients to resolve any such matter to the best of our ability.

3.5. Car parking charges may vary from those listed on the Phoenix website. Phoenix Health & Safety is not liable for any such charges.

3.6. Whilst Phoenix Health & Safety does its best to keep venues as listed on the website, Phoenix Health and Safety reserves the right to change the venue at any time. Delegates will be notified of any changes to the course venue. 

4. Distance Learning

4.1. For NEBOSH Certificate courses, materials are provided that are up to date at the time of booking. If materials are updated, free revisions can be provided by Phoenix. We will notify students of updates via email and/or social media platforms. For NEBOSH Diploma, the textbooks provided are up to date at the time of booking. The textbooks are from a third party supplier, so any revisions to the syllabus will require updated textbooks to be purchased. We can provide these at cost price.

4.2. All fees are payable in advance. Course materials will not be sent until payment is received. Fees quoted are correct at time of publication. Phoenix Health & Safety reserves the right to alter fees at any time. Cancellations following a confirmed booking will be charged a £30 administration fee. Once materials are sent, refunds cannot be offered. Shipment of materials to non-UK addresses may incur an additional fee.

4.3. Support from the study support team is unlimited, however the onus is on the delegate to contact tutors when in need of assistance. This can be done via telephone, email, social media, Skype, etc.

4.4. Tutor-marked assignments are provided as part of the course materials. It is vitally important that these are completed and submitted for feedback before delegates sit exams.

5. E-Learning Training Courses & Audio Books

5.1. Invoices and/or payment requests will be issued immediately upon receipt of a booking.

5.2. For individual learners (self-funded bookings), full payment must be received at the time of booking before access to any E-Learning course or Audio Book is provided.

5.3. For business, employer, or company-funded bookings, access to E-Learning courses and Audio Books will be granted upon issue of the invoice. By submitting a booking, the organisation accepts liability for the full course fee from the date of booking and agrees to settle the invoice in accordance with the agreed payment terms.

5.4. Once login details and course access have been issued, no refunds, cancellations, or transfers can be offered. 

6. NEBOSH Learning Agreement

6.1. By enrolling on a NEBOSH qualification and accepting these Terms and Conditions, delegates confirm that they have read, understood, and agree to comply with the NEBOSH Learning Agreement below. Acceptance of these Terms and Conditions constitutes acceptance of the NEBOSH Learning Agreement and its requirements.

6.2. The purpose of this learning agreement is to help learners understand their role in the overall process. It is an understanding between Phoenix Health and Safety (as the Provider) and the Learner as to who takes responsibility for what. It needs to be honoured by both parties if the learning is to be successful. The NEBOSH qualifications require significant time and commitment from learners. Phoenix Health and Safety Where appropriate we will:

  • 6.2.1. Provide you with suitable materials, which conform to the NEBOSH syllabus and course being studied, at the appropriate times.
  • 6.2.2. Encourage you during your study, providing study support through a team of tutors who are qualified in both health and safety and learning and development. 
  • 6.2.3. Respond to all study support queries within the following timescales: 
    • General enquiries – 1 working day 
    • Marking and feedback – 2 working days for certificate courses and 5 working days for Diploma 
    • Deal with any difficulties and issues promptly and fairly in line with our complaints procedure. 
  • 6.2.4. Operate an equal opportunities policy. 

 

6.3. Learner Before commencing your studies, you will:

  • 6.3.1. Read and accept the NEBOSH terms and conditions
  • 6.3.2. Complete the onboarding module of your course to familiarise yourself with the qualification structure and requirements, including reading the study guide and syllabus guidance documents. 

 

6.4. During your studies, you will:

  • 6.4.1. Utilise all of the resources and materials provided to you for your course, in addition to any supplementary resources, information and guidance provided
  • 6.4.2. Submit your own work which is a true reflection of your knowledge and abilities
  • 6.4.3. Engage positively and professionally with tutors and fellow students
  • 6.4.4. Contact a Study Support Tutor if you have any technical or learning queries
  • 6.4.5. Contact a member of the Training Admin team if you have any admin or examination enquiries. 

 

6.5. During your Open Book Assessment period, if applicable you:

  • 6.5.1. Must not Communicate with our tutors or other employees of Phoenix HSC or other learners, either by phone, e-mail or via social media for the duration of the assessment period, on the topic of the assessment
  • 6.5.2. Must not seek advice or contributions from any third party, including proofreaders, friends or family members
  • 6.5.3. Must not copy and paste information from materials as this will not gain you the marks you need to pass
  • 6.5.4. Must use your own words applying the knowledge you have gained during the course and link your answers to the scenario give in the question paper
  • 6.5.5. May use your textbooks, learning materials and other resources for reference.

7. NVQ Courses

7.1. Delegates are responsible for ensuring they are suitable for the NVQ by completing the self-assessment eligibility check prior to enrolment (Am I suitable for the NVQ Level 6). Upon enrolment, delegates will be registered with the awarding body (ProQual). If it is determined after registration that a delegate is unsuitable for the NVQ, either by the delegate or Phoenix, the delegate will be withdrawn. If a withdrawal or cancellation occurs within 14 days of registration, a £150 administrative fee will be charged to cover registration and processing costs. No refund will be provided for withdrawals or cancellations made after 14 days.

7.2. The purchase includes 18 months of support from the date of enrolment. If the qualification is not completed within this timeframe, delegates may request an extension, which will be subject to additional fees if approved.

7.3. The NVQ is a self-directed qualification, and delegates are responsible for maintaining consistent progress and contacting their assessor as needed. Assessors are available to provide unlimited support during the qualification period and will proactively reach out to provide support, but it is the delegate’s responsibility to seek assistance when required.

7.4. Delegates must complete the NVQ within three years of initial enrolment. If the qualification is not completed within this timeframe, the delegate will be withdrawn from the programme with no refunds provided.

7.5. For all NVQ programmes, full payment must be received before access to the learning platform, course materials, assessment resources, and assessor support is granted. Delegates will not be enrolled or provided with course access until the required payment has been received. Where a course extension is requested, any applicable extension fees must be paid in full before the extension is approved and access to learning resources, assessor support, and portfolio systems is continued or reinstated. Phoenix Health & Safety reserves the right to suspend or restrict access to NVQ programmes where payments are overdue.

8. In-House Training

8.1. Upon confirmation of a booking, the client accepts liability for the full agreed course fees and associated charges. Liability for payment commences from the date of booking, regardless of the course delivery date, and any cancellation or rescheduling requests will be subject to Phoenix Health & Safety's cancellation and postponement terms.

8.2. For any courses that are to be provided on the client’s premises, it is the responsibility of the client to provide the following:

  • 8.2.1. A suitable training room, large enough for all attendees
  • 8.2.2. Lunch and refreshments (if applicable)
  • 8.2.3. A projector, flipchart and pens
  • 8.2.4. Toilet and washing facilities 
9. Exams

9.1. All NEBOSH exams taken in the UK must be booked and paid in full 4 weeks before the date of the exam for self-funding customers. For business, employer, or company-funded bookings, invoice terms apply. South African exams must be booked and paid in full 8 weeks before the date of the exam. Once you have been registered for an exam the fees are not refundable.

9.2. We do accept later bookings, although it is important to note that there may be additional fees. If you submit a late exam booking and have missed the NEBOSH exam cut-off date, payment of late exam registration fees will be chargeable in order to register your exams.

9.3. Whilst Phoenix Health & Safety does its best to keep venues as listed on the website, Phoenix Health and Safety reserves the right to change the venue at any time. Delegates will be notified of any changes to the course venue.

9.4. As part of NEBOSH's Open Book Exam (OBE) process, you may be required to attend a closing interview. This is usually done virtually via Teams or Zoom. If you fail to attend a closing interview without giving us 2 working days’ notice, you will be charged £30 +VAT to re-book.

9.5. Upon booking a NEBOSH Certificate Classroom or Virtual Classroom course, you will be automatically enrolled onto the nearest exam date for that course. If you book a NEBOSH Diploma Classroom or Virtual Classroom course, you book the exam when you're ready. The exam costs are still included in the course cost.

9.6. When you book a NEBOSH Classroom or Virtual Classroom course, your exam costs are included in the cost. The cut off for changing your exam date is 3 weeks from the exam date. If you need to change the date of your exam, please contact our Operations Administration department. 

10. Phoenix Pass Pledge

10.1. Phoenix Health & Safety offer a pass pledge on all IOSH, NEBOSH ISEP and CITB courses. This means that candidates are entitled to continue studying (free of charge) if they fail to meet the required standard in the examinations. The Phoenix Pass Pledge only applies if the following criteria are met:

  • 10.1.1. The candidate is accepted onto the course by Phoenix Health & Safety.
  • 10.1.2. The candidate takes a full and active part in the course, and completes any tasks/projects set.
  • 10.1.3. The candidate attends every day of the course.
  • 10.1.4. The candidate meets the required standard in all tutor – marked assessments.
  • 10.1.5. If applicable, the delegate will be required to pay the exam fees for any re-sits. 
11. Online Payments

11.1. Before completing an e-commerce purchase, the Learner and/or Employer must confirm they have read and accepted these Terms and any applicable service-specific terms. We may retain records of such acceptance, including the date, time and version of the Terms accepted, together with records of any payment-related consents, for compliance purposes.

11.2. Where the Learner and/or Employer choose to save a payment method, purchase using an instalment plan, or enrol in a recurring or automatically renewing service, they authorise the Company (and our payment service providers acting on our behalf) to store details of their saved payment method and initiate future payments using such payment method.

11.3. The Learner and/or Employer agree that future payments may be collected using your saved payment method in accordance with the payment schedule, subscription terms, renewal terms or other payment arrangements disclosed to them at the time of purchase. Such payments may include instalments, subscription fees, renewal fees or other amounts payable under the applicable service terms.

11.4. The timing, frequency and amount of future payments will be as described during checkout, in the applicable service terms, or otherwise notified to the Learner and/or Employer before purchase. The Learner and/or Employer’s rights to cancel a service or prevent future payments are subject to the cancellation, renewal and termination provisions set out in these Terms and any applicable service-specific terms.

11.5. Any payment due will be collected using the most recent payment method saved to to the Learner’s or Employers account at the time the payment becomes due. Only one payment method may be stored on your account at any time.

11.6. Notwithstanding clause 6, Instalment payments will be collected automatically on or around the agreed payment dates using the payment method saved to the Learner’s or Employer’s account at that time.

11.7. If a payment fails, the Company may make one or more further attempts to collect the payment before contacting the Learner and/or Employer to request updated payment details.

11.8. Where a service renews automatically, the Company may charge the payment method saved to the Learner’s or Employer’s account at the time of renewal. The Learner and/or Employer may update or replace your saved payment method at any time before the renewal date.

11.9. The Company do not store full payment card details. Payment information is securely processed and stored by our payment service providers.

11.10. Where the Learner and/or Employer choose to save a payment method, the Company may retain certain information relating to that payment method, including:

(i) the card expiry month and year;
(ii) the last four digits of the card number;
(iii) a tokenised identifier generated by our payment provider representing your payment method and card type;
(iv) a payment reference used to identify and reconcile payments; and
(v) a record of your acceptance to our Terms and Conditions and saved payment method, in accordance with the above.

11.11. The Learner and/or Employer are responsible for ensuring that payment details remain accurate and up to date. The Learner and/or Employer may update saved payment method at any time through the account settings or by contacting the Company.

11.12. The Company may change payment service providers from time to time. Any stored payment methods will continue to be stored and processed securely in accordance with applicable law, payment card industry standards and the requirements of payment service providers.
